2. Scope of Services

Elanora Studios provides creative production services including, but not limited to, photography, videography, content creation, editing, and licensing for use in hospitality, tourism, and brand marketing.

3. Quotations & Bookings

All quotations are valid for 30 days unless stated otherwise.
A project is considered confirmed once the client approves the proposal in writing and the initial 50 % deposit has been received.
Travel arrangements will only be booked once the deposit has cleared.

4. Payments

• Structure: 50 % deposit to confirm the project; 50 % balance due before delivery of the final, watermark-free and high-resolution files.

• Payment term: 30 days from invoice date.

• Late payments: An interest charge of 1% of the outstanding balance per week, accruing daily, applies to overdue amounts, plus any reasonable collection costs.

• Currency & taxes: All prices are in EUR and exclusive of applicable VAT unless stated otherwise.

5. Cancellations & Postponements

• By the client: Deposits are non-refundable. If rescheduling is possible, we’ll apply the deposit to a new date within 6 months. If not, the deposit serves as a cancellation fee.

• By Elanora Studios: If we must cancel for reasons within our control, we’ll first propose alternative dates. If no solution is found, we’ll refund the deposit in full.

• Force Majeure: Neither party is liable for delays or non-performance caused by events beyond reasonable control (e.g. weather, illness, travel restrictions, natural disasters). In such cases, both parties will make best efforts to reschedule.

6. Client Responsibilities

Clients must:

• Provide timely access to locations, rooms, and relevant personnel;

• Secure any required permits, releases, or model authorisations;

• Ensure on-site coordination and safety.

If circumstances prevent capturing the agreed scenarios, we’ll adapt within the available time, but unfilmed scenes will not automatically be replaced or refunded.

7. Revisions & Additional Work

• One (1) round of revisions per deliverable is included.

• Additional revisions or alternative versions are billed at 20 % of the deliverable’s fee per extra round.

• Major creative or structural changes beyond the approved brief constitute new work and will be quoted separately.

8. Delivery Timelines

Edited Videos

• Short-form → first cut within 10 business days; subsequent versions ≈ 2 business days each.

• Long-form → first cut within 10 business days per film; subsequent versions ≈ 5 business days each.

Photography

• Unedited gallery → within 5 business days after the final shoot day.

• Edited selection → within 5 business days after receiving your final picks.

Video Clips / Databanks

• Unedited gallery → within 10 business days.

• Edited selection → within 10 business days after receiving your final picks.

Delays caused by late feedback or deliverable selections extend the timeline accordingly.

9. File Storage

Final deliverables are stored for 6 months from delivery. After that period, we may archive or delete the files. Extended or long-term storage can be arranged upon request.

10. Ownership & Usage Rights

• Upon full payment, you receive the agreed usage rights:

  • Scope: digital and online marketing use (websites, social media, paid ads, internal presentations).

  • Exclusions: print media, OOH (Out-of-Home advertising such as billboards, airport or transit ads), and other large-format physical displays require separate licensing.

  • Resale / transfer: not permitted without written consent.

  • Duration: 24 months from delivery. Extended or perpetual usage may be licensed at additional cost.

• All other rights remain with Elanora Studios.

• We retain the right to use produced work for our own marketing, website, social media, showreels, and award submissions.

11. Raw Files

Raw footage and unedited photos remain the property of Elanora Studios and are not provided unless expressly agreed in writing.
This ensures quality control, consistent editing standards, and brand alignment.

12. Travel & Expenses

All travel, accommodation, and related production expenses are payable by the client unless otherwise stated.
Costs are invoiced at cost price and may be estimated in advance.
Travel can only be booked once the initial 50% deposit has been received.

13. Liability

Elanora Studios takes great care during all productions but shall not be liable for:

• Any indirect, incidental, or consequential damages;

• Losses arising from delays, equipment failure, or data loss beyond our control.

Our total liability is limited to the amount paid to Elanora Studios for the specific project.
Clients are advised to maintain their own insurance coverage where relevant.

14. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the project, unless written consent is given to disclose.

15. Dispute Resolution & Governing Law

These terms are governed by the laws of The Netherlands.
In case of a dispute, both parties will first attempt to resolve the matter amicably through mediation before initiating legal proceedings in the competent Dutch court.

16. Amendments

Elanora Studios may update these Terms & Conditions periodically.
The version applicable to your project will be the one in effect on the date your contract or invoice is issued.
